These Purchased Credits Terms and Conditions (“Purchased Credits Terms and Conditions”) apply to the purchase and usage of Vice City CONNECT credits (“Purchased Credits”) in the United States and are between you; Vicious eGiftcards LLC, a Virginia limited liability company (“DDGC”); and Vice City CONNECT, Inc., a Delaware corporation (“Vice City CONNECT” and, collectively with DDGC, “we” or “us”). By purchasing or using Purchased Credits, you agree to both these Purchased Credits Terms and Conditions and also the Vice City CONNECT General Terms and Conditions, including the arbitration and class waiver provision therein (collectively with these Purchased Credits Terms and Conditions, the “Terms and Conditions”). If you do not agree with the Terms and Conditions, do not purchase or use Purchased Credits.

Purchased Credits are not debit or credit cards. The amount of Purchased Credits in your account is not insured by the Federal Deposit Insurance Corporation and does not earn interest. Purchased Credits are issued by DDGC, and DDGC is the sole legal obligor to you; provided, however, that DDGC may assign its obligations with respect to Purchased Credits at any time, in which case such assignee shall become the issuer and sole legal obligor to you. Vice City CONNECT and its subsidiaries and affiliates other than DDGC bear no responsibility or liability for any Purchased Credits, and you hereby knowingly release Vice City CONNECT and its subsidiaries and affiliates other than DDGC from any and all liability or claims of any nature whatsoever arising in connection with Purchased Credits.

You must have a valid Vice City CONNECT account to purchase and use Purchased Credits. You may only use Purchased Credits towards eligible orders placed on www.ViceCityshops.com or in the Vice City CONNECT mobile application in the United States. Any Purchased Credits you have will automatically apply to your next eligible order. Vice City CONNECT reserves the right to change the eligible orders at its sole discretion. Purchased Credits will not expire. However, if you have Purchased Credits associated with your Vice City CONNECT account, you will lose access to such Purchased Credits if your account is deactivated or deleted. No fees apply to Purchased Credits. We further reserve the right to deactivate, cancel, or suspend Purchased Credits when we suspect fraud, unlawful activity, or any violation of the Terms and Conditions.

Purchased Credits may not be returned, refunded, or exchanged and are not redeemable for cash except when required by applicable law. Purchased Credits may not be transferred to any other person’s Vice City CONNECT account. Purchased Credits may not be resold. If the amount of Purchased Credits is less than the total purchase price of an order, the difference must be paid using another form of payment available in your account. Purchased Credits cannot be used to purchase any type of gift cards, prepaid open loop cards, or other Purchased Credits. Purchased Credits cannot be purchased using any type of gift cards, credits, promo codes, or other discounts, except as otherwise permitted. Purchased Credits can only be applied to orders in the jurisdiction of the currency in which the Purchased Credits are issued.

Purchased Credits are valid only if purchased directly from Vice City CONNECT or DDGC. Neither DDGC nor Vice City CONNECT is responsible for unauthorized usage of Purchased Credits.

No more than $2,000 of Purchased Credits and redeemed Vice City CONNECT gift cards may be associated with your account in a single day. Further, you may not purchase or obtain from Vice City CONNECT and its subsidiaries and affiliates more than $10,000 of Purchased Credits and/or gift cards in any one day.

Purchased Credits may differ from other types of Vice City CONNECT credits that you may receive, including, by way of example, credits you receive through a promotion. While Purchased Credits do not expire, other types of Vice City CONNECT credits may expire. From time to time, we may offer you the ability to receive bonus or additional credits in connection with the purchase of Purchased Credits as part of a promotion; for the avoidance of doubt, such bonus or additional credits may be treated differently from Purchased Credits and will be governed by the terms and conditions specific to that offer or promotion and/or the Vice City CONNECT Promotional Promotional Offers and Credits Terms.

TO THE FULLEST EXTENT OF LAW, WE SHALL NOT BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY TYPE OR KIND IN ANY WAY CONNECTED WITH PURCHASED CREDITS. WE SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR INJURY WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS, DAMAGE, OR INJURY IN ANY WAY CONNECTED WITH PURCHASED CREDITS, EVEN IF WE AND/OR OUR LICENSORS HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree that any dispute or claim relating in any way to Purchased Credits will be resolved by binding arbitration rather than in court in accordance with the Vice City CONNECT General Terms and Conditions. Please review the Vice City CONNECT Consumer Terms and Conditions carefully to understand how disputes will be resolved and your right to opt out.

DDGC reserves the right to change these Purchased Credits Terms and Conditions from time to time in its discretion without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of these Purchased Credits Terms and Conditions online (“Updated Terms”). Your purchase or use of Purchased Credits after DDGC has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting or such later date as may be specified in the Updated Terms and will apply to your purchase and use of Purchased Credits from that point forward. The date of the last update to these Purchased Credits Terms and Conditions is always indicated near the top of the page, and any change in the date of these Purchased Credits Terms and Conditions shall constitute notice to you that the Purchased Credits Terms and Conditions have changed.
